South Carolina WDO Proposal Compliance

Disclaimer: Smarter Launch makes every effort to keep the information in this article current and accurate. However, South Carolina regulations can change, and it is ultimately your responsibility as a licensed operator to verify compliance requirements with your state's governing authority — in South Carolina, the Clemson University Department of Pesticide Regulation (DPR) — and to ensure your proposals meet all applicable rules and regulations. This article is for informational purposes only and does not constitute legal advice.

South Carolina requires specific elements on all WDO-related proposals and service agreements. Below is what's required and where to set each item up in Smarter Launch.

Notice Banner

All termite proposals must clearly state whether the contract covers retreatment only or retreatment and repair. Use one of the following banners on the first page of your proposal PDF.

Retreat Only:

THIS CONTRACT PROVIDES FOR RETREATMENT OF A STRUCTURE BUT DOES NOT PROVIDE FOR THE REPAIR OF DAMAGE CAUSED BY WOOD DESTROYING ORGANISMS.

Retreat & Repair:

THIS CONTRACT PROVIDES FOR RETREATMENT OF A STRUCTURE AND THE REPAIR OF DAMAGE CAUSED BY WOOD DESTROYING ORGANISMS WITHIN THE LIMITS STATED IN THIS CONTRACT.

Note: If the contract covers Formosan subterranean termites, SC Code Regs § 27-1085(B)(4) also requires your contract to specifically state whether Formosan coverage is included and whether that coverage is retreat only or includes repair of damage.

How to add in Smarter Launch: Go to Proposals > Templates and open your termite proposal template. Find the Notice Banner section and enter the appropriate banner text. The Notice Banner is designed specifically for compliance language that must appear prominently on the first page of the proposal PDF with a bold box around the text. See Creating and Editing Proposal Templates for more details.

CL-100 (Wood Infestation Report)

South Carolina requires the Official South Carolina Wood Infestation Report (CL-100) for any WDO inspection connected to a property sale or mortgage. The report must be dated within 30 days of closing and is regulated by the Clemson University DPR under SC Code Regs § 27-1085(K).

How to add in Smarter Launch: The CL-100 is available in Forms. Go to Proposals > Templates, open your WDO inspection template, and add the CL-100 from the Forms section. Configure whether the form is completed by the team member or the customer, and whether results are shown on the proposal. If the form is mapped to a PDF, also add it in the Attached Documents section set to either append or prepend. See Creating and Editing Proposal Templates and Mapping a Form to a PDF for more details.

SC Waiver of Standards

When structural or physical characteristics of a property make it impractical to complete the full minimum treatment standards, an Official SC Waiver of Standards Form must be completed, signed by the property owner, and provided to them before work begins. The waiver must use the most current version published by the Clemson DPR and must be maintained by the operator for five years or the duration of the warranty, whichever is longer (SC Code Regs § 27-1085(C)).

Note: Waivers are not required for retreatments under an existing contract, booster treatments to continue coverage, or partial treatments reinstating a contract that has lapsed for less than one year.

How to add in Smarter Launch: The SC Waiver of Standards is available in Forms. Go to Proposals > Templates, open your termite proposal template, and add the SC Waiver from the Forms section. Make sure it is also added in the Attached Documents section if mapped to a PDF so it is included in the proposal PDF sent to the customer. See Creating and Editing Proposal Templates and Mapping a Form to a PDF for more details.

Based on SC Code Regs § 27-1085 (South Carolina Code of Regulations, Chapter 27, Article 17 — South Carolina Pesticide Control). Verify current requirements with the Clemson University Department of Pesticide Regulation at clemson.edu/public/regulatory/pesticide-regulation.
